Terms of Service

1. Acceptance of Terms

By accessing or using DocNag ("Service"), operated by NOCAP LLC ("Company"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

DocNag is a document collection platform that enables bookkeeping firms to request, track, and receive documents from their clients via automated SMS reminders, email notifications, and a secure web upload portal.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the Service
• One person or entity per account unless otherwise agreed

4. Acceptable Use

You agree to use DocNag only for its intended purpose of collecting business documents from your clients. You may not:

• Send marketing, promotional, or spam messages through the platform
• Use the platform to collect personal information for purposes unrelated to bookkeeping services
• Add clients without their knowledge or reasonable expectation of receiving document reminders
• Attempt to circumvent security measures or access other users' data
• Use the platform for any illegal purpose

5. SMS Messaging

By using DocNag's SMS features, you acknowledge that:

• You are responsible for informing your clients that they will receive SMS messages
• Messages sent are transactional in nature (document requests and notifications)
• Recipients can opt out at any time by replying STOP
• You will comply with all applicable messaging laws including the TCPA

6. Documents and Data

• You retain ownership of all documents uploaded through DocNag
• We do not access, review, or use the content of uploaded documents except as necessary to provide the Service
• Documents are stored securely with encryption at rest and in transit
• Upon account termination, documents are deleted within 30 days

7. Payment and Billing

• Subscription fees are billed in advance on a monthly or annual basis
• SMS message costs may be billed separately based on usage
• Refunds are handled on a case-by-case basis
• We reserve the right to change pricing with 30 days' notice

8. Limitation of Liability

To the maximum extent permitted by law, NOCAP LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may cancel your account at any time. Upon termination, your data will be deleted within 30 days per our Privacy Policy.

10. Changes to Terms

We may modify these Terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States.
